End User License Agreement (EULA)

By using our digital channels, you accept these terms of use. These terms apply to all users of the services, regardless of whether you have created an account or use the services via identification through HMS card, ID photo, or Vipps.

1. Permitted use

Unless otherwise agreed, you may only use content from our digital channels for non-commercial, personal purposes and/or to learn about DigiQuip products and services, and solely in accordance with these terms of use.

2. Prohibited use

By using our digital channels, you agree that you will not:

Use our digital channels in violation of these terms of use.
Copy, modify or imitate the work, deconstruct or dismantle the site, or otherwise attempt to discover the source code or allow a third party to do so.
Sell, assign, sublicense, distribute, commercially exploit, or otherwise transfer rights or make available to a third party, content or services in any manner.
Use or launch an automated system, including, but not limited to: “robots,” “spiders,” or “offline readers” that use the site in a manner that sends more requests to the server in a given period of time than would be reasonably expected of a human using a typical online browser.
Use our digital channels in a manner that damages, disables, overburdens or impairs the channels or interferes with other parties’ use and enjoyment of the channels.
Mirror or include the channels in whole or in part in any other channel.
Attempt to gain unauthorized access to our digital channels.
Access our digital channels in any manner other than within the framework that DigiQuip provides for access to the channels.
Use our digital channels for any purpose or in any manner prohibited by these terms.
Any unauthorized use of the content or the channels that may violate patent, copyright, trademark, and other laws.

3. Copyright and Trademarks

Our digital channels are protected by applicable copyright law and other laws, including trademark and copyright protection laws. Our digital channels, including all works in the channels, belong to and are the property of DigiQuip or its licensors (if any). DigiQuip has all the copyright to the content. If there is no specific permission to use specific content, the content may not be copied, reproduced, modified, published, uploaded, posted, transmitted, performed, or distributed in any way, and you agree not to modify, rent, loan, sell, distribute, broadcast or create derivative works of the content on the site, partially or in its entirety, in any way. DigiQuip’s logo and other trademarks used by DigiQuip from time to time are trademarks and the property of DigiQuip.

Manuals, parts catalogues, and other material from equipment manufacturers are copyrighted and belong to the manufacturer or its licensors. The fact that such material appears on an equipment page, or that we show derived knowledge from it to whoever opens that page, does not mean the material is in the public domain. It also does not give you the right to copy, download, or redistribute the original or the derived text.

DigiQuip processes such documents to produce condensed, machine-readable summaries used to answer questions about the equipment type. Processing takes place at Mistral AI in the EU. The derived summaries are stored in our systems in Norway. Answers are shown in the conversation and cite sources when possible. We do not offer the derived files as a substitute for the original manual, and we do not claim copyright in the manufacturer’s original content. The conversation is an aid and does not replace training, the manufacturer’s instructions, or the applicable inspection regime.

You must not copy, mirror, or commercially exploit either the original material or the derived knowledge, beyond ordinary quotation rights. Customers who upload documents warrant that they have the right to let us process them as described in section 4.

You guarantee that you have the necessary rights to the material you register or share in our digital channels and that you give us permission to use and publish this material. You guarantee that you do not intend to deceive or provide misleading information, and that the material you provide does not violate these terms of use.

When using the services, you may be identified via HMS card (hmskort.no), ID photo, or Vipps. Personal data collected through these methods is stored in our Registry as described in our Privacy Policy. Account creation is handled by Logto, which stores your email address; we only store a reference to the account in our systems.

On equipment pages you may ask questions of an equipment expert. Answers are based on derived knowledge from manuals and type-level instructions, optionally the organisation’s own notes, and in some cases a stored research brief about the brand and model. See section 3 for copyright.

Our AI partner Mistral AI processes text, images, voice, and documents in the services. All processing takes place in GDPR-compliant data centers within the EU.

Text you enter, including questions in the equipment conversation, is analysed by Mistral AI’s language models. Questions and answers in the equipment conversation are not stored as chat history with us; they are held only in working memory for the current visit. Mistral AI does not retain this text after processing.
Images for AI-based image interpretation: DigiQuip and Mistral AI store a small thumbnail of the image for support and error tracking purposes; images are not permanently stored after processing.
Voice is transcribed in real time to text; audio data is not retained after transcription.
Documents (typically equipment manuals and type-level instructions) are sent to Mistral AI for text recognition (OCR) and condensation. DigiQuip stores the derived texts (extracts and model knowledge) in our systems in Norway and uses them later in the equipment conversation. The original file remains where it already lives; we do not store a new public copy of the manufacturer’s PDF as a substitute for the original.

When you use web search features in the services, search queries are transferred to our partner Linkup.so for semantic search processing. Linkup.so does not use queries for AI training and deletes data after the service is delivered. Data is processed and stored within the EU. For brand and model, DigiQuip may also store a short research brief, written by Mistral AI from the search, on the equipment type in the Registry and use it as supplementary context in the equipment conversation. By using these features, you consent to your search queries being processed by Linkup.so as described in our Privacy Policy.

Video capture and editing in the app uses IMG.ly CE.SDK, provided by IMG.ly GmbH (Germany). All video content is processed locally on your device and exported directly to our storage – no video or image data is transferred to IMG.ly. However, the SDK automatically sends device identifiers and export metadata (media type, resolution, FPS, and duration) to IMG.ly’s servers for license validation and billing. Data is processed in Germany (EU). See our Privacy Policy for more information.

When you use video transcription features in the services, video and audio content is processed by Amberscript (The Netherlands) for speech-to-text transcription. Transcribed text is not retained after delivery. See our Privacy Policy for more information.

When you use video dubbing features in the services, video content is processed by ElevenLabs (UK, EU data residency enforced) for automated dubbing with per-speaker voice reproduction. Content processed may include the voices of individuals appearing in the video. Data is processed at ElevenLabs’ EU data residency infrastructure and is not used for model training. Subtitle text derived from video transcriptions may be sent to DeepL (Germany) for translation into target languages. Text is processed via DeepL’s Text Translation API and is not retained after translation. Data is processed and stored in Germany (EU). See our Privacy Policy for more information.

5. Links to Third-Party Websites

Links to or information about third-party websites are provided solely for your convenience. If you use these links, you will leave our digital channels. Such links or information do not imply that DigiQuip endorses, recommends, or sponsors third-party websites or the information contained therein. DigiQuip is not responsible for the availability of such websites. DigiQuip is not responsible or liable for such websites or their contents. If you use links to external sites, you will leave our digital channels and be subject to the terms and privacy policies in effect on those sites.

6. File Downloading

DigiQuip cannot guarantee or be held responsible for files available for download through our digital channels being free of viruses or other harmful data code, files, or programs.

7. Disclaimer/Limitation of Liability

DigiQuip and our partners make no warranty for the suitability, reliability, availability, timeliness, security, or accuracy of our digital channels or their contents. All information, software, products, services, and graphics are offered “as is”, without any form of warranty.

To the extent permitted by applicable law, under no circumstances shall DigiQuip be liable for any losses or damages in any form arising from or in connection with the use of our digital channels, whether based on contract, compensation, neglect, liability, and even if DigiQuip has been informed of the possibility of damage.

8. Indemnification

You understand and agree that you are personally responsible for your own conduct in our digital channels. You agree to indemnify, defend and hold DigiQuip, affiliated companies, partners, licensees, employees, agents, and all third-party information services harmless from and against all claims, losses, expenses, damages and costs (including but not limited to direct, incidental, consequential and indirect damages) and reasonable legal fees resulting from or arising out of or in connection with your use, misuse or inability to use our digital channels or the content, or any breach of these terms.
